O R D E R

This order is in continuation of the order dated 17.8.2018, on which date, having regard to the limited grievance raised by the petitioner herein against his being declared ineligible for the post of Head Constable (GD) against the sports quota in the CRPF on the ground that his height is 169 cms. against the prescribed height of 170 cms. of male candidates in the general category, it was deemed appropriate to direct the petitioner to present himself before the Chief Medical Officer of the Medical Unit in the Delhi High Court Complex, for his height to be measured. 2.

We are informed that the petitioner had appeared before the Chief Medical Officer of the Medical Unit in the Delhi High Court Complex on 20.8.2018. A report of the CMO has been placed before us in a sealed envelope. On opening the same, it transpires that the petitioner's height has been recorded as 170 cms. The said report is taken on record. W.P.(C) 8579/2018

The plea of the petitioner that he meets the eligibility of the height prescribed for the subject post, is borne out from the medical report dated 20.8.2018. If there are any remaining medical tests that the petitioner has to undergo, the respondents shall give him a written intimation for appearing before the concerned authority, within one week from today. If the petitioner clears the said tests, then he shall be appointed to the subject post within four weeks from the date of conclusion of the further tests, if any, required. 4.

At the time of appointing the petitioner, his pay fixation shall be done and seniority granted, from the date of appointment of his batch mates to the subject post. However, the petitioner shall not be entitled to any back wages. 5.

While allowing the present petition, it is clarified that this order shall not be treated as a precedent in any other case. 6.
