This hearing has been conducted through hybrid mode. CRL.A. 1035/2009 & CRL.M.A. 16054/2025 (for abatement of appeal due to death of Appellant) 2.
This is an application for abatement of the present appeal, moved on behalf of the Appellant's wife - Mrs. Mahinder Devi, with the following prayer:
"It is, therefore, most humbly prayed before this Hon'ble Court that keeping in view the above stated facts and circumstances, the proceedings of the above titled appeal may kindly be abated on account of death of appellant, in the interest of justice."

Vide order dated 08th July, 2025, the Court has directed as follows: "State has filed the report confirming that the appellant has since expired on 08.06.2024.

The application for abating the appeal has been filed only on behalf of the wife of the appellant and not on behalf of the other legal heirs of the deceased appellant.
At this stage, learned counsel undertakes to file No Objection of the other legal heirs also.

The factum of death of the Appellant has been duly verified by the Respondent-State and in this regard, Status Report dated 04th July, 2025, has been filed.

No Objection Certificates, in the form of affidavits, have already been placed on record on behalf of the other legal heirs of the Appellants, namely, Mr. Vikas Bhardwaj, Mr. Vishal Bhardwaj, and Mrs. Neelam Gupta, being the sons and daughter of the Appellants, respectively. 6.
Learned counsel for the Appellants submits that the application deserves to be allowed, as all the legal heirs of the Appellant, who are not desirous of prosecuting the present appeal, have furnished their No Objection Certificates consenting to the abatement of the present appeal. 7.
Accordingly, the application is allowed and the appeal stands disposed of as abated.
