Learned counsel for the petitioners states that the present petition has been filed seeking a direction to the respondent no.1 to take appropriate action including demolition against the unauthorised construction carried out by the respondent no.2 in property bearing No.9722, Sector „C‟, Pocket 9, Vasant Kunj, New Delhi. He states that during the pendeny of the present petition, the respondent no.2 has already approached the Appellate Tribunal, MCD being aggrieved by the demolition order passed by the petitioner no.1 and, therefore, he has instructions not to press the writ petition any further as it is evident that the respondent no.1 has now initiated action against

respondent no.2 as per law.

2. The petition and pending applications are dismissed as withdrawn.
