CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

O R D E R

% 02.08.2016 The prayer made in the present writ petition has been perused. This petitioner was filed in December, 2012. The petitioner had been allotted a contract to run a parking site Under Flyover Narula Restaurant, Defence Colony, New Delhi. This was sometime in the year 2012. This Court has been informed by the petitioner that the contract was for a period of one year but he voluntarily abandoned the contract sometime in the year 2012 i.e. after filing of the present writ petitioner.

In view of the facts noted above, this petition has become infructuous.

Submission of the learned counsel for the petitioner is that he is entitled to certain compensation as this parking site has been allotted to him by the Corporation whereas the stand of the Corporation in WP(C) No.1711/2012 as recorded in the order dated 10.4.2012 is that this land belongs to the DDA, is the reason for his abandonment of the contract. Counsel for the petitioner on a query put on this count submits that he had abandoned the contract as the DDA had excavated the site. This prayer of the petitioner cannot be considered in this petition. He is at liberty to take appropriate legal remedy as permitted by law.

No further orders are called for in this petition. Petition disposed of.
