% 26.02.2016 Petition under Section 85 of the Delhi Land Reforms Act, 1954 (in short 'the Act') filed by petitioner before the SDM/Revenue Assistant, Alipur is still pending.

Grievance of petitioner is that respondent is trying to forcibly dispossess him during the pendency of the said proceedings before the SDM/Revenue Assistant. Vide order dated 21st December, 2009, parties were directed to maintain the status quo with regard to title, possession and construction on the subject land.

It is pointed out by the counsel for respondent that the SDM/Revenue Assistant is competent to pass the interim order(s) during the pendency of proceedings under section 85 of the Act. Learned counsel for petitioner submits that he will move an appropriate application before the SDM/Revenue Assistant for interim reliefs in the

pending proceedings.

Writ petition is accordingly disposed of with liberty to petitioner to file the appropriate application before the SDM/Revenue Assistant. Till the order is passed on the application of petitioner by the SDM/Revenue Assistant, interim order dated 21st December, 2009 shall bind the parties. All the other miscellaneous applications are disposed of as infructuous. A.K. PATHAK, J.
