At the outset learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file a fresh one in case on a preliminary assessment under Section 15 of the Juvenile Justice (Care and Protection of Children) Act the Board comes to the conclusion that the respondent No.2 is required to be tried in a Children's Court and not before the Juvenile Justice Board.

Petition is dismissed as withdrawn.
