% 31.07.2017 The relief sought is a limited one - a direction to send the application for reference under Section 18 of the Land Acquisition Act, 1894. The award in the present case was made on 30.08.2006 in respect of various lands, including that of the petitioner. The petitioner alleges that a reference petition was made on 18.11.2008. In these proceedings, the orders reflect that the respondents sought particulars on a previous hearing to verify whether indeed reference application was made in 2008 or later. Whatever be the position, the Court is of the opinion that the reference petition filed (Annexures P-3 and P-4) along with relevant files as existing should be forwarded to the Court. The right of the parties to make all submissions and raise all contentions, - including
the right of the revenue to contend that the reference ought not to be entertained on the ground of limitation are, however, kept open. The Land Acquisition Collector shall forward the relevant papers within four weeks from today.
The writ petition is disposed of in the above terms. S. RAVINDRA BHAT, J S.P.GARG, J JULY 31, 2017/ajk
