% 13.08.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court along with her counsel and accepts notice. Respondent no.2 submits that she has settled all her disputes with the petitioner no.1 of her own free will and without any undue force, pressure or coercion, vide an Agreement dated 28.05.2018. She further submits that her marriage with petitioner no.1 has been dissolved by a Decree of Divorce dated 18.07.2018 by Family Court, Central District, Tis Hazari Courts, Delhi.
The petitioner no.1 has paid a sum of `15,00,000/- to respondent no.2 in Court vide demand draft, photocopy whereof has been placed on record. She further submits that she has received the settled amount and has
no objection in case FIR No.295/2009 under Sections 498A/406/34 IPC registered at police station Pahar Ganj and the consequent proceedings are quashed against the petitioner and his relatives. Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of, in the above terms.
