% 21.03.2016 Learned counsel for the respondent submits that in terms of order dated 17th October, 2014, ITBP conducted afresh PET of the petitioner on 8th October, 2015 in which the petitioner again did not qualify in 1.6 km race. Respondent has placed Annexure R-2 along with the counter affidavit. Learned counsel for the petitioner seeks permission to withdraw this petition with liberty to challenge Annexure R-2 in accordance with law. The petition is dismissed as withdrawn with liberty as prayed for. J.R. MIDHA, J.
