O R D E R

% 21.05.2015 A perusal of FIR shows that shots were fired in the air. Unfortunately Ms. Preeti, who was standing on the roof of the building got injured from that gun shot.

Learned APP submits that as per the FIR two persons had fired in the air. He further submits that it is the petitioner who had shot at Ms.Preeti. He further submits that in her supplementary statement, Preeti, has stated that accused aimed towards her and fired.

Learned counsel for the petitioner submits that weapon of offence has not been recovered from the petitioner. It cannot be said that he had fired aiming Preeti. In the FIR complainant has specifically alleged that gun shots were fired in air.

Preeti has already been discharged from the hospital about one year ago.

Investigations are complete and trial is going on. Petitioner is in custody for the last more than seven months.

Keeping in mind totality of the circumstances, petitioner is admitted to bail subject to furnishing a personal bond in the sum of `15,000/- with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Dasti.
