% 26.08.2016 The petitioner has filed the present petition seeking quashing of FIR No.114/2013 registered on the complaint of the complainant under Sections 498A/ 406/ 34 IPC against the petitioners.
The complainant is present in Court. She is identified by her counsel. The petitioner No.1 and the respondent No.2 are married according to Hindu rites on 08.11.2011. Since disputes arose between the parties, they started living separately and respondent No.2 filed her complaint leading to
registration of the aforesaid FIR at Police Station Bawana. The parties have arrived at a settlement vide judgment dated 03.08.2016 in HMA Petition No.559672/2016, copy of which has been placed on record. Under the settlement, out of the total amount of Rs.11 Lakhs, the complainant has already received an amount of Rs.8 Lakhs. An amount of Rs.3 Lakhs has been tendered in Court today by way of pay order No.014041 dated 25.08.2016 drawn on HDFC Bank, Bali Nagar. The complainant states that she joins the prayer for quashing of the FIR in question.
Accordingly, no useful purpose would be served in proceeding further with the FIR in question and the proceedings arising therefrom. The same are hereby quashed.
