The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.75/2015 registered under Sections 6/14/16 POCSO Act and Section 506 IPC at PS Pul Prahlad Pur. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. By an order dated 24.04.2015, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has joined the investigation since then.
Her husband Sunil, the alleged rapist has been arrested. He was in custody since 07.04.2015. Regular bail has been granted to him today in Bail Application 266/2016. Allegations against the petitioner are that she called the prosecutrix to her house BAIL APPLN. 775/2015
where her husband committed rape upon her.
Upon completion of investigation, charge-sheet / supplementary charge-sheet has already been filed.

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, she be released on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. She shall, however, join the investigation as and when required.

The bail application stands disposed of.
