% 31.03.2016 C.M. Appl. No. 9745/2016 This application has been moved by the workman/respondent No. 2 praying that the instant petition be disposed off in terms of the settlement dated 4th March, 2016 concluded between the parties before the Delhi High Court Mediation and Conciliation Centre, whilst also praying that an amount of Rs.4,33,581/- deposited by the petitioner in this Court be released to him along with accrued interest as envisaged in the settlement.
Counsel for the non-applicant/petitioner is present. He accepts notice and states that he does not wish to file any reply to this application and that he does not oppose the prayer. W.P.(C) 4240/2015
At the same time, he has also handed over at the Bar an affidavit on behalf of the petitioner sworn by Sh. Shyam Mohan Gupta, proprietor of the petitioner-firm, approbating the aforesaid settlement, whilst also stating that the entire amount deposited by his firm in this matter with the Registrar of this Court be released to the workman/respondent No.2. The said affidavit is taken on record. Counsel for the applicant/workman further specifically approbates the aforesaid settlement and states that with the release of the said amount, his client would have no further claims against the petitioner and the aforesaid Award be deemed to be satisfied accordingly.
Consequently, the aforesaid amount along with interest accrued thereon, be released to respondent No. 2 by the Registry after completing the necessary formalities within three weeks from today. Under the circumstances, the application is allowed. The settlement dated 4th March, 2016 shall also form part of this settlement.
The writ petition, as well as the accompanying applications, are disposed off accordingly.
