% 21.12.2016 Learned counsels for the respondents submit that the writ petition is not maintainable as the workmen have not been made parties and the petition has been filed through the President of the Union. It is further submitted that the writ petition has become infructuous as the purchase order has already been issued.

Learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to file fresh petition. The writ petition is dismissed as withdrawn with liberty as prayed for. Pending applications are disposed of.
