% 30.09.2016 There is delay of 198 days in filing the accompanying appeal. An application under Section 9 of the Arbitration and Conciliation Act, 1996 filed by respondent has been allowed with the direction that on account of default on the part of appellant to pay the instalments, the vehicle in question be repossessed.
Impugned order is of November, 2015 and this appeal is being now filed after an inordinate delay of 198 days.
On a query, learned counsel for appellant submits that the vehicle in question i.e. a truck, has been already reposed in the last week of May, 2016. After some arguments, learned counsel for appellant submits that this appeal is ill-drafted and seeks permission to withdraw this appeal with liberty to file fresh one with complete particulars.
