The petitioners Akram Khan, Sahid Khan, Mazhar Khan and Sarfraz Khan, sons of Shameem Khan seek anticipatory bail in case FIR No. 543/2016 under Sections 323/341/354/427/506/34 IPC registered at PS Tilak Nagar, Delhi.

Contention of learned counsel for the petitioners is that the wife of petitioner No.4 lodged a complaint against the wife of the complaint in the above noted FIR on 20th June, 2016 and as a counter blast to the said FIR the above noted FIR was registered.

The allegations of the complainant in the FIR No. 543/2016 are that BAIL APPLN. 1761/2016

around 12.30 AM while she was taking a stroll in her street, petitioners, whom she knew from before, caught hold of her and gave beating and tore her clothes. One of them pressed her neck. They threatened and abused her in filthy language and broke the window panes and damaged their vehicle. 11.

In W.P. (Crl.) No. 949/2017 filed by the petitioners seeking quashing of the above noted FIR, which has been withdrawn by learned counsel for the petitioners, an affidavit of the complainant of the above noted FIR has been placed on record stating that since she has settled the matter with the petitioners she has no objection to the quashing of the FIR. 12.

In view of the fact that a settlement has been arrived at between the parties, this Court deems it fit to grant anticipatory bail to the petitioners. It is, therefore, directed that in the event of arrest the petitioners be released on bail on their furnishing a personal bond in the sum of ₹25,000/- each with one surety of the like amount each to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that they will join the investigation as and when directed by the Investigating Officer and will not leave the country without prior permission of the court concerned. In case of change of address, the same will be duly intimated to the Court concerned by way of an affidavit.
