% 28.02.2018 It is stated by counsel that both these appeals have been amicably settled and that appropriate action would be taken by them under Order 23 Rule 3 Code of Civil Procedure, 1908. Furthermore, both counsel submit that in terms of the settlement, the respondent/plaintiff is entitled to withdraw the amounts deposited by the appellant with accrued interest. RFA(OS)(COMM) 2/2016 & 3/2016

Parties are directed to be present before the Registrar on 12.03.2018, who shall ensure that the accrued amounts are paid over to the respondent/plaintiff, in accordance with the settlement (arrived at).

In view of the above order, learned counsel for the appellant seeks liberty to withdraw these appeals unconditionally. Appeals are accordingly dismissed as withdrawn.
