This hearing has been done through hybrid mode. 2.

The present appeal was admitted on 07th November, 2014. On the same date, the sentence of the Appellant was suspended in case RC bearing no. 5(S)/89/CBI/SIU-X/ND.

The present application is filed on behalf of the surety of the Appellant, who is also the son of the Appellant. It is stated that the Appellant has already expired on 30th August, 2023 and it is prayed that the FDR of the surety be released.

The factum of death of the Appellant has been duly verified by the Respondent and in this regard, Status Report dated 25th September, 2024, has been filed.

interested in pursuing the Appeal further.

Keeping in view of the fact that as the Appellant has already expired, so the present appeal stands abated.

Bail bond of the Appellant stands cancelled. The Surety of the Appellant stands discharged. The FDR of the Surety be released to the Surety, after proper verification and authentication. 8.

Accordingly, the present appeal stands disposed of along with pending applications, if any.

A copy of the order be sent to the concerned Jail Superintendent and the Trial Court for information.
