% 18.07.2017 IA No.7468/2017 & CS(COMM) 1134/2016 An Undertaking dated 8th May, 2017 is given by Mr.Taranpreet Singh Lamba, Vice President of the defendant company and in lieu thereof, the counter claim No.60/2014 filed by the plaintiff on 14.10.2014 shall be withdrawn. It is further stated that the suit of the plaintiff be decreed in terms of para Nos.4 & 5 of the Undertaking dated 8th May, 2017.

In view of the submissions made, the counter claim filed by the plaintiff against the defendant is dismissed as withdrawn and the suit of the plaintiff is decreed in terms of the Undertaking dated 8th May, 2017 given on behalf of the defendant company. The decree shall incorporate the terms of the undertaking dated 08.05.2017 and be prepared accordingly.
