O R D E R

% 10.04.2017 The parties have settled the disputes by way of a settlement agreement dated 16.03.2017 which is on record.

The settlement agreement delineates that the second party shall pay to the first party a total sum of Rs.5,20,000/- against the total liability of Rs.18,76,933/- towards full and final settlement but subject to the realisation of the cheque and the post dated cheque which was handed over to the first party by the second party. The agreement also takes note of the fact that the cheque has been issued with the consent of Akiko Services for the purposes of settlement of liability which had arisen between the parties and that the post dated cheque would be honoured without fail. Learned counsel for the petitioner submits that the amount has been received and no dispute is now left to be decided.

Considering this aspect of the matter, viz. a valid and legal settlement between the parties and the fact that the petitioner has received the payment, the present arbitration petition is disposed of in view of the settlement agreement.
