% 24.04.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 21st October, 2016 passed in CC No.633/2015 wherein the respondent undertook to pay Rs.10 crores on or before 10th March, 2017. Learned counsel for petitioner states that despite the aforesaid order, respondent has not paid any amount till date. A perusal of the paper book reveals that the matter is still pending before the Court of Metropolitan Magistrate, Saket Courts, New Delhi and the said Court has recently issued non-bailable warrant against the respondent.
In view of the said development, this Court is not inclined to entertain the present contempt petition at this stage.
Consequently, learned counsel for petitioner wishes to withdraw the present contempt petition at this stage with liberty to file afresh in the event the cause of action arises.
