During the course of arguments, counsel for the appellants, on instructions, seeks permission to withdraw this Regular Second Appeal with liberty to file appropriate independent proceedings for seeking registration as Class I contractor with the respondent no.1. It is also stated that the appellants comply with the requirements for granting registration as Class I contractor of the respondent no.1/DDA and which cause of action will be pleaded in the appropriate independent proceedings; be it a suit or a writ petition; and reliefs will be accordingly claimed. RSA No.19/2013

Accordingly, this Regular Second Appeal is allowed to be withdrawn with the aforesaid liberty.
