% 19.01.2018 IA No.821/2018 This application is filed under Order 1 Rule 10 CPC on behalf of the defendant to bring on record details of its merger and change in constitution. Present suit is stated to be filed against Glenmark Generics Limited. During pendency of the suit the original defendant has entered into an amalgamation with Glenmark Pharmaceuticals Limited which has been recorded and approved by the Bombay High Court. Hence, it is prayed that the defendant be substituted for Glenmark Pharmaceuticals Limited. Learned counsel for the plaintiff has no objection to the application. Same is allowed.
CS(COMM.)1143/2016 The Delhi High Court Mediation and Conciliation Centre has sent a Settlement Report dated 24.10.2017 recording that the parties have entered
into a Settlement. Terms and conditions of the settlement have been incorporated in the Settlement Agreement dated 23.8.2017. The terms and conditions of the Settlement are legal and valid. Parties shall remain bound by the terms and conditions of the settlement agreement. In terms of the settlement agreement the present suit is disposed of .
Counter Claim No.116/2016 In view of the order passed above, present counter-claim also stands disposed of.
In view of the Settlement Agreement before the Delhi High Court Mediation and Conciliation Centre the parties shall be entitled to refund of the Court Fees for the suit and counter-claim. JAYANT NATH, J JANUARY 19, 2018 n
