O R D E R

This is an application filed jointly by parties for recordal of compromise. Parties have amicably settled their disputes. Parties have agreed that out of the sum lying deposited in this court, Rs.10 lakhs will be released to the Respondent and the remaining amount be refunded to Appellant. On 21st April, 2017, this court had directed that the execution shall remain stayed, subject to the deposit of the entire decretal amount. The decretal amount has since been deposited. An amount of Rs.11, 92,500/- is lying in a Fixed Deposit with this court.

In view of the settlement between the parties, it is directed that Rs.10 lakhs be released in favour of the Respondent within a period of two weeks. The remaining amount along with all accrued interest thereon shall be

refunded to the Appellant.

Since the matter has been settled between the parties, court fee is directed to be refunded. The Respondent undertakes to withdraw the execution petition (Vinay Gogia v. Prudent Project Pvt. Ltd. Pending in Tis Hazari Courts).

The impugned judgment/decree is modified as settled between the parties. The appeal is disposed of as settled. 5.

List before the Registrar for release of the amount in favour of the Appellant and the Respondent on 3rd April, 2018. 6.

The next date before the court is cancelled.
