O R D E R

1. The present petition was filed by the petitioner in public interest seeking the following prayers:- "i. Issue of a writ of mandamus, or such other suitable order or direction, to the Ld. Registrar [Rules Committee], Hon'ble High Court of Delhi [acting in his 'administrative' capacity) to exercise the jurisdiction vested in him and frame within a timebound period to be stipulated by this Hon'ble Court the draft Rules under the Contempt of Courts Act (1971] for the consideration of the High Court's Rule Committee so that the High Court may duly exercise its powers vested by Section 23 of the Contempt of Courts Act (1971) and approve the Rules framed under the Contempt of Courts Act (1971).

ii. To grant costs for the petition, and which costs be in line with the norms laid down by the Hon'ble Supreme Court in the case of Salem Advocates Bar Association vs. Union of India (AIR2005 SC3353-1).

iii. Pass a Speaking Order on each prayer [including on this prayer).

iv. And pass such other order or further order or orders as this Hon'ble Court may deem fit and proper under the circumstances of the case."

2. From the record we find that the matter has been adjourned from time to time with directions to the respondent no.1/Delhi High Court to expedite framing of the Rules under the Contempt of Courts Act, 1971.

Today, learned counsel for the respondent no.1 submits that the Rules have been finalised by the Rules Committee, Delhi High Court and are likely to be soon placed before the Full Court for consideration. She submits that once the Rules are approved in its original form or with modifications, as may be suggested by the Full Court, the same will be notified as expeditiously as possible.

4. In the light of the aforesaid stand taken by the respondent no.1, we are of the view that no useful purpose will be served in keeping the present petition pending any further.

The same is, accordingly, disposed of along with all pending applications with directions to the respondent no.1 to place the concerned Rules before the Full Court preferably within a period of eight weeks and, thereafter, in case, the same are approved with or without amendments, the same be notified within a further period of eight weeks.

5. Needless to state, in case, the petitioner is aggrieved by the said Rules once notified, it will be open for him to assail the same in accordance with law.

6. We further make it clear that we have not expressed any opinion on the grounds raised in the present petition and, therefore, it will be open for the petitioner to raise all grounds including grounds raised in the present petition, in case, he files any fresh petition to assail the Rules as and when notified.
