O R D E R

% 02.05.2024 I.A.4992/2024(under Section 151 CPC) 1.

The present application has been filed on behalf of the Defendant No. 1 for release of the keys of the trunk, which have been deposited in the Court pursuant to the Order dated 04.08.2011 to the Local Commissioner, for facilitating implementation of the final settlement arrived at by the parties before the Division Bench in FAO(OS) 372/2016 read with the Order dated 19.04.2023 in the same FAO.

parties have finally decided their disputes in terms of the Order dated 07.11.2023 in FAO(OS) 372/2016 which is to be read with the Order dated 19.04.2023. Counsels for parties have no objection if the Suit is disposed of in terms of the Orders. The LRs of the Defendant No. 9 and 10 have already signed and endorsed the Settlement vide Order dated 07.11.2023 read with 19.04.2023.

In view of the Submissions made, the Suit is disposed of in terms of the Settlement.

The Decree Sheet in I.A.4992/2024 be prepared accordingly in terms of the Settlement.

In the said Order, it was noted that the keys of the trunk that have been deposited in the Court, be released to the Local Commissioner already appointed vide Order dated 07.11.2023, to do the needful as stated therein. In view of the submissions made and no objection from the plaintiff or the defendants , the keys of the trunk along with the inventory be handed over to the learned Local Commissioner for implementation of the Settlement Order.

The report of the Local Commissioner be submitted in the Court after the execution of the Commission.

The Appliction is accordingly disposed of.
