CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

O R D E R

% 24.08.2016 C.M. No.30773/2016 (Exemption) Exemption allowed subject to all just exceptions. Application disposed of.

W.P.(C) 7484/2016 and C.M. No.30774/2016 Petitioner is aggrieved by the fact that illegal and unauthorized construction is being permitted to be carried out at property no. A-101 & 102, Bharat Vihar, Rajapuri, Delhi and the statutory bodies had not taken any action on this count.

On advance notice counsel for respondents no. 2 to 4 has put in appearance. His submission is that all illegal activities, if any, will be stopped and action in accordance with law will be taken by the

Department and implemented in true letter and spirit. At this stage, learned counsel for the petitioner informs this Court that as per their calculation demolition order qua this property had been passed on 10.03.2016. If this position is correct action will be taken qua that demolition order and it shall be taken to this ultimate goal.

At this stage, counsel for the respondents no. 1, 5, 6, 7 and 8 submits that as per her information no construction activity is going on since last two months.

Be that as it may. Noting the above contention, if this submission of the petitioner is correct that alleged illegal activity is being carried out on the aforenoted property, it will be the incumbent duty of the statutory bodies i.e. respondents no. 2 to 3 who will take assistance of respondents no. 1, 5, 6, 7 and 8 to ensure that such activity is further not permitted to be carried out. The action taken will be informed to the petitioner.

No further orders are called for in this petition. Petition disposed of.
