IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4212/2018 MANOJ MEHTA & ORS.

..... Petitioners Through:

Mr. G.B. Sewak, Adv.

versus STATE & ANR.

..... Respondents Through:

Mr. M.S. Oberoi, APP for State with SI Shri Gopal, P.S. Shakarpur.

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 21.08.2018 It is submitted that petitioner no.1 (husband) and respondent no.2 (wife) have started living together after settling their disputes, therefore, FIR No. 294/2012 under Sections 498A/406/34 IPC registered at police station Shakarpur and the consequent proceedings may be quashed. Respondent no.2 is present in Court and has been identified by SI Shri Gopal of police station Shakarpur. She admits that she has settled the matter with her husband, inasmuch as, is living with him since September, 2014. She further says that she has no objection if the FIR and the consequent proceedings are quashed.

Keeping in mind that husband and wife have started living together after ironing out their differences, inasmuch as, wife does not wish to pursue

the FIR, in my view, no fruitful purpose would be served in keeping them entangled in the criminal proceedings.

Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
