% 20.11.2019 I.A. 15313/2019 This is an application filed under Order XXIII Rule 1 read with Section 151 CPC for withdrawal of the suit.

Learned counsel for the plaintiff / applicant states that in view of the settlement agreement, entered before the Delhi High Court Mediation and Conciliation Centre on 6th August, 2019, she wishes to withdraw the suit. Learned counsel appearing for defendant nos.1 3 & 4 acknowledges the fact that the Settlement Agreement dated 6th August, 2019 has been entered between the plaintiff and the defendant nos. 1, 3 and 4 before the Delhi High Court Mediation and Conciliation Centre. In view of the payer made for withdrawal of the suit, the prayer is allowed. The suit is dismissed as withdrawn.

Learned counsels for the plaintiff and the defendant no.s 1 3 and 4 state that the parties shall be bound by the settlement agreement. Their

statement is taken on record.

I.A. 15314/2019 This is an application filed by the plaintiff for refund of the court fee. In view of the fact that the parties have settled their disputes even before framing of issues, the plaintiff is entitled to refund of court fee in accordance with law.

The application stands disposed of.
