% 16.09.2016 During the pendency of divorce proceedings between respondent no.2 and petitioner, the present FIR No.297/2015 under Sections 323/452/506/507 IPC was registered at police station Rani Bagh on the complaint of respondent no.2 against the petitioner, in respect of the incident triggered by some trivial matter. It is submitted that matter has been settled between the petitioner and respondent no.2, inasmuch as their marriage has already been dissolved by a decree of divorce dated 23rd August, 2016, by mutual consent, passed by the Family Court, North West District, Rohini,
Delhi.
Respondent no.2 is present in Court and has been identified by SI Manmohan Ahuja PS Rani Bagh.
She submits that in view of settlement, she is not willing to pursue the present FIR any further. Keeping in the mind the fact that petitioner and respondent no.2 have settled their disputes, inasmuch as, their marriage has already been dissolved by decree of divorce by mutual consent, in the interest of justice, the present FIR No.297/2015 under Sections 323/452/506/507 IPC registered at police station Rani Bagh is quashed.
Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
