% 26.08.2016 Crl. M.A. No. 13143/2016 Allowed, subject to all just exceptions. Application is disposed of. W.P.(CRL) 2491/2016 On the complaint of respondent no. 2, present FIR No. 306/2011 under Section 420 IPC was registered at Police Station Paschim Vihar. Respondent no. 2 alleged that petitioners had induced her as also respondent nos. 3 to 7 to invest money with them on the assurance that they will repay double the money invested by them within three years. However, after taking the money, petitioners went missing. Petitioners and respondent nos. 2 to 7 have
settled their disputes vide Memorandum of Understanding dated 6th August, 2016 (Annexure B).
Respondent nos. 2 to 7 are present in Court and have admitted that they have received the entire settled amount. It is noted that quantum of the settled amount has not been mentioned in the Memorandum of Understanding dated 6th August, 2016.
Respondent nos. 2 to 7 have orally stated in this Court that they have received double the amount invested by them with the petitioners.
Keeping in mind that petitioners and respondent nos. 2 to 7 have settled their disputes amicably and the settled amount has already been received by respondent nos. 2 to 7 and also the fact that transactions between the parties have civil flavour, in the interest of justice, FIR No. 306/2011 under Section 420 IPC registered at Police Station Paschim Vihar and the consequent proceedings emanating therefrom are quashed.
