% 08.05.2017 The present application has been filed under Section 439 Cr.P.C. for the grant of regular bail in FIR No.583/2016, under Sections 365/376D/366/367/370/370-A/34 IPC, Police Station Nihal Vihar.

It has been submitted that in the present case, the accused is behind the bars since 19.07.2016. During the course of arguments, it has been brought before the Court that charge has already been framed and next date fixed before the trial court is 11.05.2017 for evidence of the prosecutrix.

At this stage, counsel for the petitioner wishes to withdraw the present bail application to move the fresh application after the recording of the statement of the prosecutrix. Consequently, the present bail application is dismissed as

withdrawn.

However, the withdrawal of the present application shall not come in the way if the petitioner wishes to move the fresh application before the Court of Session for the grant of bail after completion of evidence of the prosecutrix.
