% 26.08.2016 Petitioner is aggrieved by the fact that his application seeking mutation of his property measuring 47 bighas and 7 biswas situated in Khasra No.1/132 (20-16); 1/311 (19-00) and 1/536 (7-5) situated in Village Mundhela Khurd, New Delhi has not been answered. His submission is that his application is lying pending before the Competent Authority since 2001 and there has no decision on his application.
On advance notice, learned counsel for the respondent has put in appearance. He disputes this submission. His submission is that the matter had in fact been adjourned sine die in view of the pendency of the proceedings i.e. RSA No.13.2013 which was finally decided on
22.01.2013. The petitioner had thereafter moved an application seeking revival of his application for mutation only in August, 2013 and a down loaded copy of the judgment of the High Court was placed before the Competent Authority only in April, 2016. All these facts have been admitted by the petitioner. In this background, since the application of the petitioner is lying pending before the Competent Authority/SDM, the matter shall be decided expeditiously and preferably within an outer limit of six months from today.
Petition disposed of.
