Mr Sharma, learned counsel appearing for the respondent states that by a consent an order passed on 27.09.2016 in OMP (I) (Comm.) 36/2015 an Arbitrator has been appointed. He further states that although the respondent has filed an application under Section 16 of the Arbitration and Conciliation Act, 1996 before the Arbitrator but there is no dispute that the order dated 27.09.2016 was passed with the consent of the parties.
