% 23.09.2019 CM APPL No.42413/2019 It is submitted by the learned counsels present that the matter has been settled between the parties amicably and the appellant has agreed to pay to the respondent no.1 a sum of Rs.5,72,616/- in full and final settlement towards all claim against the appellant and the appellant has issued a cheque bearing no.000547 dated 17.09.2019 drawn on HDFC bank for the said sum in terms of settlement. It shall be the duty of appellant to ensure the cheque is encashed. It is alleged respondent no.2 is a performa party and no relief was claimed against them.

In the circumstances the appeal stands disposed of. Pending applications, if any, also stands disposed of. No order as to costs.
