% 23.09.2019 CM APPL No.42414/2019 It is submitted by the learned counsels present that the matter has been settled between the parties amicably and the appellant has agreed to pay to the respondent no.1 a sum of Rs.1,86,905/- in full and final settlement towards all claim against the appellant and the appellant has issued a cheque bearing no.000157 dated 17.09.2019 drawn on HDFC bank for the said sum in terms of settlement. The appellant ensure the cheque shall be encashed upon presentation. It is alleged respondent no.2 is a performa party and no relief is claimed against them.

In the circumstances the appeal stands disposed of. Pending application, if any, also stands disposed of. No order as to costs.
