% 30.08.2016 Crl.M.A.13403/2016 By this application, the petitioners seek exemption of petitioner No.2 from appearing before this Court, as she is suffering from paralysis. For the reasons stated therein, petitioner No.2 is exempted from appearing before this Court. The application is disposed of. Crl.M.C.3121/2016 By the present petition, the petitioners seek quashing of FIR No. 599/2012 under Sections 498-A/406/307/201/34 IPC registered at PS Mandawali, Delhi on the complaint of Respondent No.2, Laxmi. Learned APP for the State, on instructions from the Investigating Officer, submits that in the above noted FIR, presently there are two
accused, as the third accused has been discharged vide order dated 26th September, 2014 by the learned Trial Court.
Respondent No. 2 is present in Court and is identified by her counsel. She states that she has settled the matter with the petitioners and in terms of the settlement divorce by mutual consent has been granted between her and petitioner No.1. She states that she has already received a sum of Rs.1,50,000/-, in lieu of all her claims of maintenance, streedhan, alimony, she has no claim whatsoever against the petitioners and that she does not want to pursue the abovementioned FIR and the proceedings pursuant thereto.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No.599/2012 under Sections 498A/406/307/201/34 IPC registered at PS Mandawali, Delhi and proceedings pursuant thereto are hereby quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
The petition is disposed of. Order dasti.
