% 16.01.2018 CM 1693/2018 (delay) There is delay of 35 days in filing the accompanying review petition.

Upon hearing, I find that averments made in the instant application provide sufficient cause to condone the delay occasioned. The application is allowed and the delay stands condoned.

The application is disposed of.

REV.PET.32/2018 Vide order of 7th November, 2017, writ petition seeking payment of retiral benefits was disposed of as on the said date, certain payments reflected in the order of 7th November, 2017 were made to petitioner. In this review petition, it is submitted that only the admitted amount has been paid by respondent-School whereas more than rupees W.P.(C) 7521/2016

two lacs is still payable by respondent-School and in this regard, an email Representation was made by petitioner on 17th November, 2017 (Annexure-II). Learned counsel for petitioner submits that email Reply of 24th November, 2017 (Annexure-III) was received from respondentSchool to the effect that payment has been made as per the directions of this Court.

Despite service of advance notice, none appears on behalf of respondents.

Upon hearing, I find that petitioner has already made an email Representation (Annexure-II) asserting that the amount paid was not calculated according to recommendations of 7th Pay Commission. In view thereof, instead of recalling the order of 7th November, 2017, it is deemed appropriate to call upon respondent-School to effectively consider petitioner's Representation (Annexure-II) within a period of four weeks from today. In case petitioner's grievance still survives, then respondentSchool shall give a calculation to show that the entire dues have been paid, so that petitioner may take recourse to law as available in law, if need be.

Respondent-School be apprised of this order forthwith to ensure its compliance.
