% 18.10.2016 Learned counsel for the petitioner states that elections were held and R.N. Bhardwaj, respondent No.2 has been elected by the members of the Cooperative Society.
In case, the petitioner has any grievance against the elections or against the election of respondent No.2, they will have to avail the appropriate remedy in accordance with law. In view of the aforesaid position, prayer (b) to the writ petition does not survive. Prayer (a) is for issuance of direction to the Registrar, Cooperative Societies to dispose of the representation of the petitioner
for conduct of special audit.
The present writ petition would be treated as a representation made by the petitioner to the Registrar, Cooperative Societies. The Registrar, Cooperative Societies may call upon respondent Nos.2 and 3 and/or the newly elected management committee before passing any order.
Learned counsel for the petitioner has expressed apprehension that the matter will remain pending for long. She states that earlier representations/complaints have not been disposed of. It will be open to the petitioner to write a letter to the Registrar, Cooperative Societies drawing his attention to the earlier representations/complaints.
We hope and trust that the Registrar, Cooperative Societies will examine the representation i.e. the present writ petition in earnest and would pass appropriate orders as expeditiously as possible. With the aforesaid observations, the writ petition is disposed of. SANJIV KHANNA, J.
