% 11.01.2019 Crl.M.A. No. 12676/2017 By this application, the State seeks condonation of delay of 410 days in filing the leave to appeal.
For the reasons stated in the application delay is condoned. Application is disposed of.
CRL.L.P. 452/2017 The State seeks leave to appeal against the impugned judgment dated 6th January, 2016 whereby the respondent/accused was acquitted of the charge for offences punishable under Sections 323/509 IPC. Learned CRL.L.P. 452/2017
counsel for the complainant and the respondent/accused submit that the complainant had also challenged the impugned order dated 6th January, 2016 by filing an appeal before the learned Additional Sessions Judge wherein a settlement was arrived at between the respondent/accused and the complainant pursuant whereto appeal filed by the complainant was withdrawn.
Copy of the order dated 1st August, 2018 seeking withdrawal of the appeal filed by the complainant has been placed on record. Considering the fact that the complainant has settled the matter with the respondent/accused, this Court finds no ground to interfere in the impugned judgment by granting leave to appeal to the State. Petition is dismissed.
