% 24.11.2016 We are not inclined to interfere with the order of the Tribunal dated 17.09.2001. The respondent C. Bheemanna has already retired from the service. The amount which the petitioner seek to recover is Rs.70,248/-.
It is stated that the excess payment were made from 1997 to 2001.
Learned counsel for the petitioner has submitted that the petitioner has given an undertaking.
We have examined the said undertaking dated 31.03.2010. The undertaking was given in view of the representation made to drop the recovery proceeding relying on judgments of the Supreme Court.
In this factual background and noticing the quantum of amount involved, the period to which the amount paid relates we would exercise our discretion and not entertain the present writ petition. The amount is too paltry to be examined.
