% 13.11.2017 Learned counsel for the plaintiff submits that the law firm which was engaged by the plaintiff is no more receiving any instructions from the plaintiff. Further though the name of the law firm was mentioned, however the vakalatnama was signed in favour of two counsels who have left the law firm. The vakalatnama in favour of the learned counsel now appearing is not on record.

Considering the fact that no instructions are forthcoming from the plaintiff and despite repeated adjournments and defendants No.1,2,3&5 having already been proceeded ex-parte and defendant No.4's right to file written statement having been closed on 13th August, 2012, till date the plaintiff has not filed its affidavit of evidence, the suit is dismissed for nonprosecution.
