% 13.03.2018 The counter affidavit of respondent No. 1 is on record. In paras 8, 9 and 10 of the counter affidavit the stand of the respondent is delineated. The action on the complaint of the petitioner has already been taken upon which notices has been issued under Section 628 and 629 of the Companies Act; necessary sanction for initiation of proceedings under the aforesaid provisions of law has been granted and the matter is now subjudice before this Court. Learned counsel for the respondent points out the petition has become infructuous and it is clear from the prayer made in the petition.
