The present appeal was passed over on the first call as none was present on behalf of the appellant. Same is the position on pass over. 2.

On the last date of hearing, learned counsel for the appellant had sought an adjournment to place on record the medical certificate relating to the appellant's ill-health for explaining the delay of 115 days in filing the appeal. The appellant has failed to file the said record.

It appears that the appellant is not interested in prosecuting the present appeal which is accordingly dismissed in default and for non-prosecution.
