O R D E R
% 01.03.2018 The plaintiffs filed this suit for permanent injunction restraining infringement of copyrights; delivery up, rendition of accounts of profits, damages to the tune of Rs.40.00 Lac against the defendants. The matter was referred to the Delhi High Court Mediation and Conciliation Centre, New Delhi and vide settlement agreement dated 19.01.2018 the matter has been settled between the parties on the terms and conditions as set out in para No.6 of said settlement agreement, available on the record.
It is stated by both the learned counsels for parties that this settlement has been arrived at between the parties without any undue influence exercised upon and they shall abide by the said terms of settlement and shall be binding upon the parties. The learned counsel for the plaintiff also have no objection if the computer systems sealed by the learned local commissioner are
de-sealed and released to the defendants. The defendants undertook to clean their computer systems within three days from the release of said systems to them.
In the circumstances as aforesaid, the suit of the plaintiff is decreed in terms of settlement enumerated in para No.6 of the settlement agreement dated 19.01.2018. The terms of settlement as embodied in para No.6(supra) shall form part of the decree. Decree Sheet be drawn accordingly.
Parties to bear their own costs. However, as the matter has been settled through mediation, the plaintiff shall be entitled to refund of Court fee as per provisions of the Court Fees Act. YOGESH KHANNA, J MARCH 01, 2018 M
