The petitioner had sought directions for refund of the excess VAT lying with the respondents. The Court had issued notice on 21st August, 2018. Just a day before the next date scheduled for hearing i.e. 16th November, 2018, the DVAT authorities passed an order, adjusting the amounts sought in these proceedings. That order of DVAT authorities dated 15.11.2018 is the subject matter of another writ petition, which has been field and is yet to be heard.

In the light of these subsequent developments, the claim in this writ petition is rendered infructuous. However, it is open to the petitioner to urge all contentions available in law and which were also urged in the present proceedings.
