W.P.(CRL) 2524/2016 The petitioner has filed the present petition seeking quashing of FIR No.190/2016 registered on the complaint of respondent No.2/ complainant under Sections 406/ 420/ 467/ 468/ 471 IPC at Police Station - Jagat Puri, against the petitioner.
Issue notice. Mr. Mahajan accepts notice on behalf of the State. Respondent No.2 is present with his counsel and he accepts notice. Learned counsel states that he has already filed his Vakalatnama on record. Respondent No.2 states that he has arrived at a settlement with the petitioner. In terms of the settlement, he has received an amount of Rs.2,50,000/-, i.e. Rs.2,10,000/- by way of pay order No.074616 dated 18.08.2016 drawn on HDFC Bank, Vikas Marg, New Delhi, and Rs.40,000/- in cash today in Court. He, therefore, prays that he does not wish to pursue his complaint any further and the FIR in question be quashed. Looking to the nature of the allegations, no useful purpose would be served in proceeding further with the FIR in question. The same is quashed subject to deposit of Rs.25,000/- in the Prime Minister's National Relief Fund. The costs be deposited within two weeks and the receipt of the same be provided to the I.O., whereafter the case shall be quashed. VIPIN SANGHI, J AUGUST 29, 2016 B.S. Rohella
