This Rent Control Revision Petition under Section 25B(8) of the Delhi Rent Control Act, 1958 impugns the order [dated 5th February, 2015 in E No.177/13/12 (UID No.02401C0364602012) of the Court of Additional Rent Controller-1 (Central), Tis Hazari Courts, Delhi] of dismissal of the application filed by the petitioners for leave to defend the petition for eviction under Section 14(1)(e) of the Act filed by the respondent and the consequent order of eviction of the petitioners from portion of property No.284-A, Katra Gul Khan, Sabzi Mandi, Delhi. 2.

Notice of the petition was ordered to be issued, though no stay of order of eviction impugned granted.

On 18th April, 2016, the counsel for the respondent stated that the premises stood vacated and the respondent, on 23rd March, 2016, in execution had recovered possession and this petition had become infructuous.

Thereafter also the matter has been adjourned from time to time. 5.

None appeared for the petitioners on the last date of hearing i.e. 26th May, 2017.

None appears for the petitioners today also.

The counsel for the respondent states that the possession, in execution of the order of eviction, was recovered on 23rd February, 2016 and not on 23rd March, 2016.

It appears that the petitioners are no longer interested. 9.

Dismissed in default.
