% 06.09.2017 It is submitted that petitioner and respondent no.2 have settled their disputes amicably in as much as the settled amount of `2,80,000/- has been paid by the petitioner to the respondent no.2, therefore, offence under Section 138 Negotiable Instrument Act, 1881 may be compounded.

Respondent no.2 is present in Court along with his counsel and admits having settled the matter with the petitioner of his own free will and without any undue force, pressure or coercion. He also admits having received the settled amount from the petitioner and

submits that he has no objection if the offence under Section 138 Negotiable Instrument Act, 1881 is compounded. In view of settlement arrived at between the petitioner and respondent no.2, offence under Section 138 of the Negotiable Instrument Act, 1881, is compounded. Petitioner is acquitted. Petition is disposed of.
