O R D E R

% 15.05.2017 The petitioner seeks bail in connection with FIR No.886/2015 dated 23.6.2015 under Sections 307/324/509 and 34 IPC. The petitioner is said to be in custody since 11.4.2017 The petitioner is a young person who is alleged to have caught hold of the victim, who was later stabbed by another co-accused, namely, Jagmal. There appears to be series of disputes between the side of the prosecution and the family of Jagmal.

This Court has been informed that the Jagmal who is alleged to have stabbed the victim, has been granted anticipatory bail by this Court. The petitioner was not charge sheeted, but the learned Magistrate, after going through the police papers and after taking into account that the petitioner was named in the FIR with the specific role of caching hold of the

victim differed with the police report and took cognizance against the petitioner.

Taking into account the period of custody of the petitioner and the fact that the main accused has been granted bail, the petitioner is directed to be released on bail on his furnishing a bond of Rs.10,000/- with one surety of the like amount to the satisfaction of the Trial Court. However, the petitioner shall join the investigation as and when required by the Investigation Officer. In case the petitioner is found to be avoiding the investigation, it will be open to the State to apply for cancellation of the anticipatory bail.

The Bail Application stands disposed of.
